Terms of Use

1. The Service

EndPointBlank is a platform for managing API endpoint access control, credentials, and monitoring. We may add, change, or remove features at any time.

2. Eligibility and accounts

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your registration information, for maintaining the confidentiality of your account credentials and API credentials, and for all activity that occurs under your account. Notify us promptly at support@endpointblank.com of any unauthorized use.

3. Acceptable use

You agree not to:

• use the Service in violation of any law or third-party right;
• access or use another party's data without authorization;
• interfere with, disrupt, or place undue load on the Service or its infrastructure;
• attempt to gain unauthorized access to any system or account, or probe or test the vulnerability of the Service except as expressly permitted;
• reverse engineer or attempt to extract source code except as permitted by law; or
• use the Service to transmit malware or unlawful, infringing, or harmful content.

4. Your data

You retain all rights to the data you submit to the Service ("Your Data"), including the monitoring and log data your applications send. You grant us a worldwide, non-exclusive license to host, process, transmit, and display Your Data solely to provide and improve the Service. You are responsible for Your Data, for having the necessary rights and consents to submit it, and for configuring the Service's masking and access controls appropriately. You must not submit data you are not permitted to share.

5. Plans, billing, and payment

Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. Usage limits are enforced per day according to your plan. Fees are non-refundable except where required by law. We may change our prices on prior notice; changes take effect at your next billing cycle. If a payment fails or your account is past due, we may suspend or limit the Service. You can cancel at any time, and cancellation takes effect at the end of the current billing period.

6. Intellectual property

The Service, including its software, design, and content (excluding Your Data), is owned by Bengal Technologies LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

7. Third-party services

The Service relies on and integrates with third-party services, including Amazon Web Services, Stripe, Mailgun, and Sinch. Your use of those integrations may be subject to their terms, and we are not responsible for third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENGAL TECHNOLOGIES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Bengal Technologies LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of Your Data, your use of the Service, or your violation of these Terms.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends and we may delete Your Data in accordance with our Privacy Statement.

12. Governing law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin, and you consent to personal jurisdiction there.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
